如果是to be settled,那解决这个问题的人就不是句中的主语,而是别人了.这与下文,“他现在很忙.”不符合了.
下面这个语境就可以：
With a lot of problems to be settled,he is now very relaxed.
其实这时的with 和 have 差不多,见下例：
I am leaving for Beijing tomorrow.Do you have anything to be taken there?

且 with的主语 与 句子的主语 一致，也就是 with的主语就是 he

因为这个句子的主语是he，with a lot of problems to settle做的是he的补语，he settle problems，是主动的，如果是be settled，那么主语应该是物了
